Sol — Terms of Use

1) Acceptance & Scope

By accessing or using the Sol iOS app and related in-app services (the "Service"), you agree to these Terms of Use ("Terms") and our Privacy Policy, which is incorporated by reference.

These Terms constitute a binding agreement between you and NUNE LLC ("we," "us," "our," or "Sol"), a Wyoming limited liability company.

2) Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher, to use the Service. By using Sol, you represent that you meet this requirement and have legal capacity to agree to these Terms.

3) Apple Terms

If you downloaded Sol from the Apple App Store, Apple’s Licensed Application End User License Agreement applies to your use of the app. These Terms supplement Apple’s terms. Apple is not responsible for the Service, its content, maintenance, support, warranties, claims, or legal compliance, except as required by Apple’s applicable terms.

4) Consent to Photo Processing

To provide the Service, Sol processes the photos you choose to submit. By selecting a photo and requesting an edit, you authorize Sol and its service providers to transmit, process, temporarily cache, and return the photo and resulting output as needed to provide the requested edit, secure the Service, troubleshoot errors, prevent abuse, and comply with law.

We do not intentionally retain your submitted photos after processing. However, photos or related technical data may be temporarily retained by our service providers according to their security, processing, abuse-prevention, and legal compliance practices. We instruct our AI providers not to use your photos to train their models, except where you separately authorize it.

5) Your Content and AI Outputs

You retain ownership of photos you submit to Sol. You grant Sol a limited, temporary, worldwide, non-exclusive, royalty-free license to host, transmit, process, modify, and display your submitted photos solely to operate, secure, improve, and provide the Service to you.

You are responsible for ensuring you have the necessary rights and permissions to submit photos to the Service. Do not submit photos you do not own or have permission to use.

AI outputs may be inaccurate, incomplete, unexpected, or visually imperfect. You are responsible for reviewing outputs before using or sharing them. You may use outputs for lawful personal or commercial purposes, subject to these Terms and applicable law.

6) Acceptable Use

You may not use the Service to:

• violate any law or third-party right, including privacy, publicity, copyright, trademark, or other intellectual property rights;
• upload photos of another person without appropriate rights or consent;
• create deceptive, harassing, exploitative, defamatory, non-consensual, sexual, or otherwise harmful content;
• create or distribute content involving minors in a harmful, sexualized, exploitative, or deceptive manner;
• impersonate another person or misrepresent AI-edited content as authentic where doing so may mislead or harm others;
• upload malware or attempt to interfere with, reverse-engineer, scrape, overload, or bypass the Service, security controls, or rate limits.

7) Third-Party Services

The Service may rely on third-party services, including AI processing, analytics, attribution, payment, and infrastructure providers. Their terms and privacy practices may apply to their services. We are not responsible for third-party services except to the extent required by law.

8) Subscriptions and Payments

Some features may require a paid subscription. Subscription options, including title, duration, price, renewal terms, and included features, are shown before purchase in Apple’s in-app purchase flow.

If you purchase through Apple, payment will be charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your Apple ID may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings. Refunds, billing, and cancellation are handled by Apple, except where applicable law requires otherwise.

9) Copyright and IP Complaints

If you believe content processed through or associated with the Service infringes your rights, contact us at contact@nunellc.com with enough information for us to review the issue, including your name, contact information, a description of the rights at issue, and the allegedly infringing material.

10) General Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, Sol is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses. Our aggregate liability for all claims related to the Service will not exceed the greater of (A) amounts you paid in the six (6) months before the claim, or (B) USD $50.

11) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by reasonable means, such as through the app or by updating the effective date. Your continued use of the Service after changes take effect means you accept the updated Terms.

12) Miscellaneous

Export & sanctions: Do not use the Service in violation of export control or sanctions laws.

Governing Law: These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Sol for the Service.
